Governor Signs Bill Aimed to Protect Students against District Superintendents' Failure to Act

Governor Jerry Brown has signed CTA co-sponsored-AB 449 by Assemblymember Al Muratsuchi (D-Torrance). The bill received unanimous support in both the Assembly and Senate.

The bill requires district superintendents to report to the California Commission on Teacher Credentialing (CCTC) on allegations of misconduct of certificated staff when warranted to keep students safe and safeguard the profession.

AB 449 fixes weaknesses in the current law by making a superintendent who fails to make the required reports in a timely fashion liable to discipline by the credentialing agency and possible misdemeanor prosecution by a local district attorney. Reports to the CCTC about serious misconduct can prompt the agency to revoke the credential of the accused – certificated employee or superintendent – if the facts warrant.

The bill’s provisions are designed to make it virtually impossible for a certificated employee fired from one district for serious misconduct to be hired by another.
