Fact Sheet - AB 1338 (Buchanan)

 

District Implementation of Policy on Reporting Child Abuse
Keeping Students Safe, Safeguarding the Profession and Protecting Rights of Educators

AB 1338 (Buchanan) requires all school districts to have a policy on mandated reporting and to review that policy with all employees annually.

AB 1338 contains two basic requirements:

• The governing boards of all school districts, charter schools and county offices of education must develop and adopt a policy for the reporting of child abuse that complies with current law. Policies should comply with the Child Abuse and Neglect Reporting Act (Education Code section 11164, et seq.)
• School districts, charter schools and county offices of education must review the policy with their employees within the first six weeks of each school year.

(Current law requires this review at the initial hiring of school employees.)
